1 . Introduction
TVUp Streaming Media S.L. (“TVUp”, “we” or “us”) is the controller of the personal data processed under this privacy policy and, as such, must ensure that the processing is in accordance with applicable law.
By registering for a user account, the user (“you” or “User”) acknowledges the processing of his or her personal data by TVUp in accordance with the following provisions.
This Privacy Policy explains the collection, use, and sharing of information from or about you in connection with your use of the TVUp Services. The term “TVUp Services” refers to our TVUp video Services, including the selection of television channels, television programs, clips, movies, APPs, and other content we offer (collectively, the “Content”) and our player for viewing the Content (the “Video Player”), as well as any other products, features, tools, materials, or other Services TVUp offers from time to time through a variety of access points. The term “Access Points” refers, collectively, to the TVUp.es and TVUp.cat websites (the “TVUp Web”), the MediaCenter for TV (Android TV STB), web and mobile applications (Android and iOS), and other places through which the TVUp Services may be accessed, including websites and applications of TVUp’s third-party distribution partners and other websites on which users or website operators may embed the video player.
By viewing any Content or using the TVUp Services, whether you are a subscriber, other registered user, or a visitor who has not subscribed or registered for the TVUp Services, you agree to the collection and use of information from or about you explained in this Privacy Policy. If you do not agree to the collection and use of information from or about you in accordance with this Privacy Policy, then you may not use the TVUp Services.

The processing of your personal data is summarized below. You will find more detailed information after this summary.
We need to use personal data in order to provide you with the TVUp Services. This means that you cannot object to us processing all of your personal data and still require us to provide the TVUp Services. However, you have the right to object to certain uses of your personal data, for example if the use in question is not essential for us to provide you with our TVUp Services, but is only necessary, for example, to send you advertising by email. This right is explained in more detail in point 6 “Your privacy rights”
As a data subject, you also have a number of rights that allow you to better understand and influence the processing of your personal data by TVUp. These rights include a right to access the personal data that TVUp holds about you, to request that we correct incorrect data, to request that we delete personal data, and the right to lodge a complaint with the supervisory authorities if you have a problem with the use of your personal data by TVUp. These rights are explained in more detail in point 8 of this Privacy Policy, “Use of information we collect”.
The personal data that we process corresponds to the information that you have provided to us when registering an account with TVUp through your telecommunications operator. We also process personal data that you may have otherwise provided to us when contacting TVUp (for example, via an email request), as well as information that you may have provided to us when participating in a survey. TVUp will also analyse how you use our website.

4. Sharing Information with Third Parties
We may share information collected about you with third parties, as explained below, including business partners, social media services, service providers, advertisers, and other companies not affiliated with TVUp.
Business Partners. We work with a number of business partners who help us deliver TVUp services, including, for example, our content programmers, distributors, and telecommunications operators, among others. We may share information collected from or about you with such business partners.
Social Media Services. When you choose to share information with social media services about your activities on the TVUp Services, including the channels you watch or like on TVUp, information about you and your activities will be shared with those social networks.
Service Providers. We may share information collected from or about you with companies that provide services to us and our business partners, including companies that assist in payment processing, analytics, data processing and management (for example, to facilitate our advertising and publicity efforts), account management, hosting, customer and technical support, marketing (for example, email, online communications, or direct mail), and other services.
Your Browsers and Devices. We may work with service providers who use information collected from or for you to help us identify the browsers and devices you use for various purposes, including targeted advertising, analytics, attribution, and measurement purposes. For example, these service providers (together with TVUp) may use your activity on one browser or device to serve you more personalized advertising on another browser or device. In connection with your use of browsers and devices, please note that certain opt-out choices you have apply only to the specific browser or device from which you opt out.
Advertisers and Advertising-Related Service Providers. We may share information collected from or about you in hashed, aggregated, or non-identifiable forms with advertisers and service providers that perform advertising-related services for us and our business partners in order to tailor advertisements, measure and improve advertising effectiveness, and enable other improvements. This information includes your use of the TVUp Services, the websites you visited, the advertisements you viewed, and your other online activities.
Audience Measurement Providers. Our business partners, such as content programmers, as well as our advertisers, seek to measure the performance of their creative material across many platforms, including the TVUp Services. Accordingly, TVUp may permit the use of third-party measurement software that enables third parties (such as Nielsen) to include your viewing on the TVUp Services in the calculation of measurement statistics, such as television ratings.
Third Parties When Required by Law or When Necessary to Protect Your Rights or Ours. In some cases, we may disclose information from or about you without giving you a choice. For example, we may disclose your information in the following ways: to protect the legal rights of TVUp and our affiliates or partners, and each of our respective shareholders, directors, officers, employees, agents and business partners; to protect the safety of users of the TVUp Services or third parties; to enforce our Terms of Use; to protect against fraud; for risk management purposes; and to comply with or respond to law or legal process or a request for cooperation by a governmental entity, whether or not required by law.
Third Parties in Connection with Certain Transactions. If we sell all or part of our business, make a transfer of assets, or otherwise might be involved in a change of control transaction, or in the event of bankruptcy, we may transfer information from you to one or more third parties as part of the transaction, including the due diligence process.
Parties with your consent or when you choose to share otherwise. In addition to the sharing described in this Privacy Policy, we may share any information about you or your family members with us.
